Can a tax preparer withhold my documents?

I had a question in regards to a tax preparer. I was wondering if they are allowed to keep my W2 form and all other documents? I had originally made an appointment with the tax preparer on Feb. 3 2016, my domestic parter was also planning to have her assist him with filing. After going back and forth on deciding who should claim my son on the tax return, my partner and I decided to come put some thought into it and go back another day. I would like to mention that we were also missing documents such as my sons social security number, and nothing was finalized on that day. Therefore a couple of weeks went by, and we decided that we were going to go back to pick up our paper work and ask for a different opinion elsewhere. Before that i went in on Feb. 20th to pick up the paper work, but the tax preparer who kept my paper work was not in. I was instructed that day to sign a form in order for my documents to be released and pick them up on Monday the 22nd. I did sign the paper for release of my documents thinking that i only had to pick up them up on Monday. So Monday comes which is today, and to my surprise the tax preparer gives me two options, one is to finalized everything and go through with filing my taxes there. The second option was to pay a fee of $365 dollars due to the time invested on providing me and my partner with quotes. When my partner questioned the fee for releasing our documents to us, she stated that her supervisor intructed her not to release the papers, because of the time invested giving us quotes one form took her 45 minutes to analyze the second form took her 26 min. She also said that she was only able to deduct 100 dollars from the 365 fee and release our documents at 265. She said that the amount due was also based on the fact that most of our information was entered into her system. My question is, can she withhold our documents? I repeat nothing was finalized nor was there any document signed by me or my partner signifying that we had finalized anything.
