Do I have to plant a tree straight upwards? I would like a leaning tree instead?

I have an area of garden with concrete running under the bed, but I'd like a tree canopy there. The only solution I can think of is planting a tree closer to the fence, where the soil is deeper, leaning sideways so that it extends over the place that I'd like to cover with the canopy. I will support the tree with a stake so that it doesn't fall over. Is there anything else I should worry about?

or:When planting a tree sideways, one side will not be able to get enough sun and will rot, so planting it upwards is the only way to have a good tree
