Hello, In 2013 an 85 year old man pulled out in front of oncoming traffic when being impatient at a stop sign and I ended up hitting his vehicle. I did not have insurance at the time and of course the accident was deemed his fault. I never went to court about it either, all that happened after the accident was I got a very small check from his insurance company for the loss of my vehicle.
Today I was trying to get insurance on my new truck and the insurance company told me it was going to take $200 to get it started and that I had to pay $115 every month ( a $45 jump from the last time I was paying insurance) which is all fine but the problem I am having is this. They told me I was "flagged" for not having insurance during my car accident last year which I guess I can understand and what not since insurance is a big deal but its what they told me after that that is bugging me. They told me that if I get into another car accident NO MATTER WHAT the situation It will automatically be deemed as my fault. Yupp, they told me that if a drunk driver were to hit me while I was parked at a traffic light the accident would be my fault and I would have fines and jail time. This does not seem to be legal at all and if it is What the hell?!?! I get it if I cause the accident I may have additional problems because of me now having insurance last time but if I get hit by anyone at anytime it is automatically my fault?? Someone please explain this to me.

or:thing is they think it sounds like they don't want to pay anything they must think their insurance isn't at fault thats what it sounds like when a accident occurs they issue points which that tells them that it brings up your insurance so it costs more they must have different laws around different states each are different thats wrong if they told you it was automatically your fault just doesn't sound i would call the dmv and talk to them about it i would also call another insurance company find another to go through you can't guarentee them you won't get in another accident thats totaly wrong when some of the insurance companys tell you they forgive this
