The court makes the decision based on what is in the best interest of the child.How did the biological parents lose the child in the first place? What were they doing and how did it happen? Were police reports filed? When a child is found why wasn't there a missing child report filed in the system so when the child was found they could have returned the child? What were the bio parents like? What are their histories like any trouble with the law, paid their bills, had jobs? Was the kid well cared for when they had custody? What were doctor appts for and did the kid get well baby care and was the kid in school and how was the kid doing?Lots of factors to be considered. I have no idea what the answers to all those questions might be. My question would be why couldnt they find the bio parents when they found the kid? I'd be inclined to leave the kid with the adoptive parents but then I'm not a lawyer.
