I'm on probation I've only worked there a week and know I do not want to stay at all.

in my contract it says I must give one weeks notice to leave during probation. However, the law says you must give a weeks notice if you have worked at least a month which I haven't.

I'm still concerned they will accuse me of breaching the contact though.

But I feel they have breached their side of the agreement by changing my hours at short notice and not paying for me to stay longer on one shift. - would this be a valid argument or a dangerous one. Also how binding is the weeks notice in this situation.

I want to leave asap what would be your best advice?

I was planning on sending an email so they have a written copy but also phoning that morning to warn them.

please help thank you

or:You will have breached contract. We are not talking about their side of the contract whether they did or did not. We are talking about the agreement you agreed to and what you signed. So the answer is yes you would have breached your legal agreement. What that legal response would be i dont know.If you have a union talk to them.

or:What will happen is if you try to get another job and they call this company, they might refuse to hire you because they don't want a fellow who breaks a contract.

or:Depends on the job. And the company. But if a signed contract does give them a bit more control. Talk to a lawyer in your area. With a signed contract a company could go after you in law suite. For the time they didn't have employees or for having to pay overtime. They had you sign that contract for a reason. Be careful it could come back and bite you hard.
